What are the new proposed Asylum Rules and their implications for settlement?

Introduction
 Recent changes to the UK asylum system represent a significant shift, introducing stricter eligibility criteria and extending the qualification period for settlement to 20 years.

Here is a summary of the key changes

  • Increased Waiting Period: Asylum seekers must now wait 20 years before they can apply for permanent settlement in the UK, up from the previous 5-year requirement. This extended period specifically applies to those arriving via small boats or other irregular means. Individuals entering lawfully by plane are not subject to these provisions.
  • Replacement of Indefinite Leave to Remain (ILR): There are plans to replace ILR with a core protection status, which provides refugees with temporary leave to remain for 30 months. This status must be renewed, and refugees will only become eligible for settlement after having lived continuously in the UK for 20 years.
  • New Eligibility Criteria: Asylum seekers will need to demonstrate contributions to society—through employment, education, or business—to qualify for accelerated settlement routes.
  • Changes to Support and Benefits: The legal duty to provide support for destitute asylum seekers will be replaced with discretionary powers. Consequently, support may be withdrawn if an asylum seeker fails to comply with conditions or possesses sufficient means.
  • Significant Reforms and Criticism: These proposed changes have been widely regarded as substantial reforms, with critics arguing that they undermine the rights of those seeking asylum.
